Recreational Marijuana in the Workplace. Do You Have a Policy?

Twenty-six states and the District of Columbia have legalized marijuana in one for or another, and many employers are wondering how to react. Can employees bring brownies to work? Can they smoke it during lunch? Find out in this week's Learning Minute with workplace trainer Linda Garrett, JD.

Hi, I'm Linda Garrett. We've recently had some questions about recreational marijuana. A lot of states have made marijuana use legal and employers are wondering "What do we do now? Do we have to let employees bring brownies into work? It's legal, can they use marijuana during their breaks?Can they smoke marijuana during their lunch?"

It's actually pretty simple: treat it like you've treated alcohol, which is also legal. Basic line you can give your employees is you expect them to be 100% when they come to work so that they can do their job well, proficiently, and safely. If someone comes to work under the influence of drugs or alcohol, whether it's in the morning or right after lunch, you have every right to send them home. Simple as that.
